1. About These Terms

These Terms & Conditions (“Terms”) govern your access to and use of SEOMagicPRO, including our Shopify application, website and related services.

By installing, accessing or using SEOMagicPRO, you agree to these Terms. If you are using SEOMagicPRO on behalf of a business or other organisation, you confirm that you have authority to accept these Terms on its behalf.

If you do not agree to these Terms, you should not install or use SEOMagicPRO.

2. The SEOMagicPRO Service

SEOMagicPRO provides Shopify catalogue-management and optimisation functionality. Depending on the features available under your plan, the service may include:

• Product catalogue analysis and management
• Product data and metadata optimisation
• Shopify taxonomy and attribute enrichment
• Product image analysis and optimisation
• AI-assisted suggestions and catalogue workflows
• Operational history, usage and rollback-related functionality where supported

Features may change, improve or evolve over time as the service and Shopify platform develop.

3. Shopify Account and Authorisation

SEOMagicPRO operates as a Shopify-integrated application. Access to the embedded application is authenticated through Shopify.

You are responsible for maintaining the security of your Shopify account and ensuring that only authorised persons can install or use applications on your store.

By installing SEOMagicPRO, you authorise the application to access the Shopify resources covered by the permissions and access scopes approved during installation or subsequently granted through Shopify.

You must not attempt to use SEOMagicPRO to access any Shopify store or resource for which you do not have proper authority.

4. Shopify Data and Catalogue Operations

SEOMagicPRO processes Shopify catalogue information in order to provide the features requested by the merchant.

Depending on the feature selected, SEOMagicPRO may read or process product data, categories, taxonomy information, metafields, images, tags, options and other catalogue information permitted by the Shopify access scopes granted to the application.

Certain features may also write changes back to Shopify when explicitly requested or approved through the relevant workflow.

You remain responsible for reviewing the suitability and accuracy of changes applied to your Shopify store and for maintaining appropriate backups or operational safeguards for your business.

5. AI-Assisted Features

Some SEOMagicPRO features use automated analysis or artificial intelligence to generate suggestions, classifications or optimisation results.

AI-generated or automatically inferred results may not always be complete, accurate or appropriate for every product or business. Where SEOMagicPRO provides a preview or approval workflow, you are responsible for reviewing the proposed result before applying it.

SEOMagicPRO should not be relied upon as a substitute for professional, legal, regulatory or product-safety advice.

6. Subscriptions, Plans and Billing

Paid SEOMagicPRO plans are provided through Shopify's application billing system.

Pricing, available plans, trial periods and other billing information are presented through Shopify or the relevant Shopify app pricing interface. A paid subscription becomes effective when approved through Shopify and confirmed as active for the relevant store.

Shopify processes charges associated with your SEOMagicPRO app subscription. SEOMagicPRO does not separately process your payment card details for Shopify app billing.

Subscription renewals, upgrades, downgrades, cancellations, trials and other billing events are subject to the plan terms presented through Shopify and Shopify's applicable billing mechanisms.

Features and usage allowances may vary according to the active plan. Where a plan includes usage limits, SEOMagicPRO may prevent additional chargeable or allowance-consuming operations when the applicable allowance has been exhausted.

7. Trial Periods

Where a trial is offered through Shopify, the applicable duration and conditions will be presented through Shopify as part of the relevant subscription or plan.

Eligibility for a trial and the transition from trial access to a paid subscription are governed by the plan information and subscription status supplied through Shopify.

8. Acceptable Use

You must not use SEOMagicPRO to:

• Violate applicable law or regulation
• Infringe the intellectual-property or other rights of another person
• Access stores, accounts or data without authorisation
• Introduce malware, harmful code or other security threats
• Attempt to bypass authentication, permissions, usage limits or security controls
• Interfere with or disrupt the operation of SEOMagicPRO or its infrastructure
• Reverse engineer or misuse the service except where expressly permitted by law
• Use the service in a way that places unreasonable or abusive load on our systems

9. Merchant Responsibilities

You are responsible for the Shopify store and catalogue on which SEOMagicPRO is used.

This includes responsibility for:

• The legality and accuracy of your product information
• Your product descriptions, claims and regulatory compliance
• Ensuring you have rights to product images and other content processed through the service
• Reviewing proposed catalogue changes where review functionality is available
• Maintaining appropriate control over who can access your Shopify administration

10. Availability and Changes to the Service

We aim to provide a reliable and secure service, but we do not guarantee that SEOMagicPRO will be continuously available or free from errors, interruptions or delays.

Availability may be affected by maintenance, infrastructure issues, Shopify availability, third-party services, network conditions, security events or circumstances outside our reasonable control.

We may modify, replace or discontinue features where reasonably necessary for security, technical, operational, legal or commercial reasons.

11. Third-Party Services and Shopify

SEOMagicPRO depends on Shopify and may depend on other third-party technology or infrastructure providers.

Your use of Shopify remains subject to your separate agreement with Shopify. We are not responsible for the availability, operation, policies or decisions of Shopify or other independent third parties.

12. Intellectual Property

SEOMagicPRO, including its software, branding, website content, documentation, interfaces and proprietary technology, is protected by applicable intellectual-property laws.

Except where expressly permitted by these Terms or applicable law, you may not copy, reproduce, distribute, modify, sell, license or create derivative works from SEOMagicPRO's proprietary materials without our prior written permission.

You retain ownership of your Shopify store data, product information, images and other content you lawfully provide or make available through Shopify.

13. Data Protection and Privacy

Our processing of personal information is described in our Privacy Policy.

SEOMagicPRO supports Shopify's required privacy and compliance mechanisms, including applicable customer data requests and shop or customer erasure requests.

14. Suspension or Termination

We may suspend or restrict access to SEOMagicPRO where reasonably necessary to protect the service, investigate suspected abuse, address security risks, comply with law, or respond to a material breach of these Terms.

You may stop using SEOMagicPRO by uninstalling the application or cancelling the relevant Shopify app subscription using the mechanisms available through Shopify.

Termination or uninstalling the application does not affect rights, obligations or liabilities that arose before termination and that are intended to survive termination.

15. Disclaimers

SEOMagicPRO is provided on an “as available” basis. To the extent permitted by law, we do not guarantee that every automated suggestion, classification, optimisation or other output will be error-free, complete or suitable for every merchant or product.

Nothing in these Terms excludes rights or remedies that cannot lawfully be excluded or limited.

16. Limitation of Liability

To the fullest extent permitted by applicable law, SEOMagicPRO will not be liable for indirect, incidental, consequential or special losses arising from or connected with use of the service, including loss of profits, revenue, business opportunity, goodwill or data.

Nothing in these Terms limits or excludes liability where doing so would be unlawful, including liability that cannot legally be excluded under applicable consumer or commercial law.

17. Indemnity

To the extent permitted by applicable law, you agree to be responsible for losses, liabilities or claims arising from your unlawful use of SEOMagicPRO, your infringement of third-party rights, or your material breach of these Terms.

18. Governing Law

These Terms are governed by the laws of England and Wales, except where mandatory law applicable to you requires otherwise.

Subject to any mandatory rights available under applicable law, disputes relating to these Terms will be subject to the jurisdiction of the courts of England and Wales.

19. Changes to These Terms

We may update these Terms from time to time where our service, technology, business practices or legal obligations change.

The current version will be published on this page and the “Last updated” date will be revised when appropriate.
